1. Agreement to Terms
By accessing or using Pebble (the "App") via website or mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access the service.
2. Use License
Pebble grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for strictly personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
3. Accounts and Registration
To use certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Subscriptions and Payments
A. Subscriptions
Pebble offers a "Plus" subscription service that unlocks premium features. Subscriptions are billed on a subscription basis (e.g., monthly or yearly).
B. Billing and Cancellation
Web Purchases: Managed via Stripe. You can cancel via the Billing portal in settings.
In-App Purchases (iOS/Android): Managed by Apple or Google. You must cancel through your Apple ID or Google Play account settings at least 24 hours before the end of the current period to avoid auto-renewal.
C. Refunds
Refunds for In-App Purchases are subject to the policies of Apple or Google. Web subscription refunds are at the sole discretion of Pebble, generally governed by a 14-day money-back guarantee policy where applicable by law.
5. Pod Interactions (No UGC)
Pebble allows you to join "Pods" to share habit progress with other users. Interactions within Pods are strictly limited to system-generated reactions (e.g., emojis) and automated progress updates.
No Open Messaging: The App does not support open messaging, chat, or free-form text input between users. You cannot send custom messages to other members of a Pod.
Conduct: While interaction is limited, you agree not to use the available reactions or account profile features to harass or spam other users. We reserve the right to terminate accounts that violate this spirit of community support.
6. AI Disclaimer
The App uses Artificial Intelligence to provide habit coaching and suggestions. This information is for informational and motivational purposes only. It is not medical, psychological, or professional advice. You should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment.
7. Intellectual Property
The App and its original content, features, and functionality are and will remain the exclusive property of Pebble and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Limitation of Liability
In no event shall Pebble, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
